While we do not track every lawsuit that Kim Kardashian has either filed or been hit with against someone else (mostly because there are not enough hours in the day), the case against Old Navy over their controversial “Super Cute” ad from last year now is officially over. According to a report from TMZ, the two parties involved have reached some sort of settlement that everyone is satisfied with. (A trial was not scheduled to happen until 2013.)
If you remember back to when this ad was released, there were all sorts of questions as to whether or not the woman singing and dancing in it was supposed to be Kim. In reality, it was an actress by the name of Melissa Molinaro who actually had a connection to the reality star (she dated NFL star Reggie Bush, a man who clearly has a type).
When we first heard about the suit, we actually felt as though Old Navy had a pretty good chance to win it based on how absolutely nothing in the video (which you can see below) references Kim, her family, or her career as a reality star. Plus Molinaro sings and dances — whereas Kim really does neither of the two things. However, what appeared to be the nail in the coffin for Old Navy in some ways was that they personally referenced the similarities between Molinaro and Kardashian in a post on their Twitter account, which was an acknowledgment of sorts that they wanted to bring Kim to mind when consumers saw the ad. Kim has a clothing line at a rival store in Sears, and the lawsuit was to largely protect the value of her image as well as her brand.
What makes this case interesting moving forward are its ramifications — that celebrities do have a right to sue over a “lookalike” appearing in an advertisement, even if the person never references her in any way.
